PORTLAND, Ore. (From news reports) -- A lawsuit has now been filed in the aftermath of the deadly implosion at the Nippon Dynawave paper mill in Longview that killed 11 workers.

Sheri Lynn King, the mother of two young men killed at the mill in May, filed her case on behalf of family members of Tyler Covington, 29, and Bradley Covington, 27.

This is the first of what will likely be many more lawsuits filed against the paper mill -- a deadly disaster that they say should have been prevented.

According to the legal complaint, the brothers had just arrived at the plant on May 26 and were in the parking lot when the nearby chemical storage tank collapsed. Hundreds of thousands of gallons of caustic chemicals spilled out and debris from the implosion crushed and the two brothers to death.

The lawsuit blames Nippon for more than a dozen failures, including not properly maintaining and inspecting plant equipment, as well as not training and supervising workers, not warning about hazards and inadequate safety and emergency response procedures.

Just a few days ago, the US Chemical Safety Board, an independent federal agency, released a report that said Nippon was warned last year about dangerously thin tank walls and that the tank that eventually imploded was at risk of failure and needed major repairs.

The lawsuit is seeking damages but does not name how much until the case goes to trial.

Nippon sent this statement:
